Terms of Service
General Terms
- By commissioning me, you are purchasing my services as an artist and agreeing to my Terms of Service.
- I reserve the right to post your finished artwork in my gallery and as a display of my work on various social medias.
- I reserve the right to decline any project or client for any reason. I am not required to disclose this reasoning under any circumstances.
- I reserve the right to cancel and fully refund your commission in the unlikely event in which I am unable to complete it. This cancellation must be on my end, and does not include a commission taking longer than you would like.
- Any and all works done by me may not be used for NFTs, Blockchain technology, or Artificial Intelligence in any way. This includes any and all designs or adopts.
- You are required to fill out the Contact Form form listed on my website. I will not accept emails, or texts to begin work.
- You will then receive a reply from me discussing the details (if needed) as well as me confirming your slot.
- I reserve the right to make changes to your request as I see fit unless otherwise discussed. To guarantee the total accuracy of your commission request, please make note of the required details and elements in the provided form.
- If your request is extremely detailed, or require extra materials, I may add a fee to account for added complexity. This fee will be stated before the transaction, and you hold the right to make changes to your commission request (eg. change the logo, character, agree to simplified design changes, etc.) before the transaction is complete and I start your piece.
- Please make your request concisely worded with minimal abbreviations, so as to make the note clear to read.
- I will work off of descriptions, but please note that this may be subjected to a complexity fee based on what is requested.
- Any emails, private messages, and comments that you send must be made in English. Using online translators is unreliable, and I am unwilling to risk translation errors.
- Before taking part in any transaction, you are required to wait for a reply so that we can discuss the details.
- I will, after everything is processed and confirmed, send you an invoice. You must confirm the payment with me before I start your order.
- With your commission you may:
- Display my work, provided there is visible credit to me using my most current username
- Use the artwork purchased for personal use (any use in which you do not gain profit– Monetary or otherwise)
- Print or create an otherwise physical reproduction of the artwork for PERSONAL USE ONLY. (ie: not for profit or sale.)
- With your commission you may not:
- Impersonate or claim my work as your own.
- Upload or host my work in any gallery that is intended to display your own work.
- Use the artwork for mass-production, redistribution or otherwise, commercial or non-commercial (ie: t-shirts, mugs, public flyers, etc.) unless otherwise discussed.
- Change, modify, or edit my work.
- Trace over my artwork, including the use of the artwork as a “base”.
- I reserve the right to sign and/or watermark my own work. You may not remove these marks.
- You are responsible for protecting your ownership over rights to a character design made by me. Once you purchase a character design, it is out of my hands.
- Likewise, in the case of an adoptable, you retain the rights to the character but must credit the design back to me.
- I will not reuse/resell the rights to the design once ownership is purchased by you, the Client.
- I retain all intellectual property rights to my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon.
- In the case of a commission, I will not claim the rights to a character design unless it was my design. Therefore I will not reuse/resell the artwork for personal or commercial projects unless agreed upon by all involved parties
- I will only accept USD via thru Square as payment. You will be sent an invoice asking for payment upon completion of the work.
- I require full payment up front before I begin working
- After 100% of the payment is sent, I will start sketching. The sketch will then be sent to you.
- I will initiate the transaction/invoice to avoid accidental transactions. Do not send me any kind of payment until I have confirmed I can accept your commission AND have asked for payment.
- If payment is not made in a timely manner (24h) after I've sent your Invoice, the commission will be canceled.
- Repeated counts of initiating a commission request and failing to pay will result in blacklisting.
- I do not offer refunds. Please make extra sure you are ready to commission me before starting the commission process and before sending payment.
- If I must cancel a project, I will reimburse the client 100% of what was paid (including fees).
- Under no circumstances is a chargeback an acceptable means of expressing displeasure with the commission, process, or payment.
- Purposefully issuing a chargeback will result in immediate blacklisting. I reserve the right to inform fellow artists of my experience.
- I may take 3-5 days to respond to any of your inquiries
- My working hours are Monday to Friday. 9 AM to 5 PM Central time.
- You may contact me outside of these hours, but I might not respond until my times of business.
- You reserve the right to set a deadline for your commission. This deadline must be disclosed prior to payment, and agreed to by both parties.
- I have the right to refuse a project if I cannot meet the requested timeline.
- My average turn-around time is 4 weeks from the time of payment.
- This timeframe may differ based on the complexity of the project or if I have multiple large projects in my queue at the same time.
- You reserve the right to be notified of any delays.
- I will only take on three commissions at a time and will work on any of them in any given order regardless of pay order.
- Your commission will be finished by the timeline agreed on unless I notify of a delay.
- Rush fees begin at + 25% of the original cost of the commission. Fees can vary depending on the project and the time frame requested.
- I will start and send a work in progress image after payment is completed.
- These images will come in the form of a .jpg file as an attachment in email (from [email protected]) or a DM (FB or IG only).
- You are responsible for ensuring your order contains the details you want me to include.
- I am not responsible for any unsatisfactory element of the design if no feedback was given to amend it.
- I will only send a progress update for the sketch and flat color, but you are free to request an update at any time.
- Two major revisions may be requested during the sketching phase of the commission. Revisions may include facial expression, hairstyle etc. Additional revisions will come at a fee based on complexity. This fee is non-negotiable.
- I will not fully re-draw a pose or concept; Please commission me with a solid idea beforehand. The more specific you can be, the better I can work! Examples are always welcome.
- Likewise, if you commission me for an artistic freedom piece, it is exactly that. You may make suggestions or things you’d like me to include, but artistic freedom pieces are entirely up to my discretion.
- After a commission is completed, minor changes such as color adjustments are allowed if the missing or inaccurate elements are my fault (e.g., I overlooked details provided in the order).
- In the absence of feedback from the customer, any changes once a piece is completed will be subject to a fee based on complexity.
- No additional revisions will be made upon final approval of a piece (with the exclusion of any errors made by the artist).
- Credit is required when you post or use the artwork on any and all platforms.
- You are responsible for saving any information, images, and other digital data I provide.
- Any file you paid for will be available from me for a finite time only. I cannot guarantee against computer failure, accidental deletion or loss.
- I am not obligated to post your project on social media or otherwise, and if posted, I may take it down as I see fit. I have the right to delete or remove any content containing your commissioned piece from social media or otherwise.
- If you intend to use any commissioned piece from me commercially, a contract detailing expected usage, royalties, and rights must be discussed and completed.
- Commercial rights fees begin at a baseline of 100% of the cost of the original piece. Pricing is affected by the amount of profit you stand to gain off of the use of my work, number of copies to be distributed, etc.
- “Commercial Use” is defined as any reproduction using my artwork for marketing or promotional purposes. This includes business cards, social media banners, physical merchandise of any kind, etc.
